Terms of Service

These Terms of Service ("Terms") govern your use of the CaloriFit mobile application ("App") operated by CaloriFit ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use CaloriFit. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App. By using the App, you represent and warrant that you meet these requirements.

2. Account Registration

• You may create an account using an email address and password, Apple Sign-In, or Google Sign-In.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate and complete information during registration and to keep your profile information up to date.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.

3. Use of the App

3.1 Permitted Use

CaloriFit is a personal nutrition tracking tool. You may use the App to:

• Log meals and track calories and macronutrients (protein, carbohydrates, fat).
• Use AI-powered food recognition to identify foods from text descriptions or photos.
• Track body weight over time.
• Save frequently eaten foods for quick logging.
• View personalized daily nutrition targets.

3.2 Prohibited Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Use automated systems (bots, scrapers) to access the App.
• Share your account credentials with others or allow multiple people to use a single account.
• Attempt to circumvent usage limits, subscription restrictions, or security measures.
• Upload content that is illegal, harmful, abusive, or infringes on the rights of others.

4. AI-Powered Features

• CaloriFit uses artificial intelligence (Google Gemini) to estimate nutritional content from food descriptions and photos.
• AI estimates are approximations. Nutritional values provided by the AI are not guaranteed to be accurate and should not be relied upon for medical, dietary, or clinical purposes.
• You acknowledge that AI-generated results may contain errors, and you are responsible for reviewing and adjusting logged values as needed.
• Free-tier users are limited to a fixed number of AI requests in total. Premium subscribers have unlimited AI access.

5. Subscriptions and Payments

5.1 Free and Premium Plans

CaloriFit offers a free tier with limited AI usage and a Premium subscription with unlimited access. Subscription details, pricing, and plan options are displayed in the App at the time of purchase.

5.2 Billing

• Subscriptions are billed through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

5.3 Cancellation

• You may cancel your subscription at any time through your Apple ID account settings or the App Store.
• Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until that date.
• We do not offer refunds for partial billing periods. Refund requests must be directed to Apple.

5.4 Restore Purchases

You can restore previous purchases at any time using the "Restore Purchases" option available in the App's paywall and subscription settings.

5.5 Price Changes

We reserve the right to change subscription pricing. Any price change will take effect for the next billing period following notice. Continued use of the subscription after a price change constitutes acceptance of the new price.

6. Health Disclaimer

CaloriFit is not a medical device and does not provide medical advice.

• The App provides general nutrition information for informational and tracking purposes only.
• Calorie targets, macronutrient goals, and AI-generated food data are estimates and should not replace professional dietary advice.
• You should consult a qualified healthcare professional or registered dietitian before making significant changes to your diet, especially if you have a medical condition, eating disorder, or are pregnant or nursing.
• We are not responsible for any health outcomes resulting from your use of the App.

7. Intellectual Property

• The App, including its design, code, features, graphics, and content, is owned by CaloriFit and protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• You retain ownership of the content you create (food logs, weight entries, photos). By using the App, you grant us a limited license to process this content as needed to provide the service (e.g., sending photos to our AI provider for food recognition).

8. Account Termination

8.1 By You

You may delete your account at any time from the Settings screen in the App. Account deletion is permanent and removes all your data from our servers. Active subscriptions must be cancelled separately through your Apple ID settings.

8.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the App in a way that harms other users or our infrastructure. We will make reasonable efforts to notify you before termination, except in cases of serious violations.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
• Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless CaloriFit, its officers, directors, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.

11. Third-Party Services

The App integrates with third-party services (Supabase, Google Gemini, RevenueCat, Apple Sign-In, Google Sign-In, PowerSync). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

12. Modifications to the App and Terms

• We may update, modify, or discontinue features of the App at any time without prior notice.
• We may revise these Terms at any time. When we do, we will update the "Effective date" at the top of this page.
• Continued use of the App after changes to these Terms constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of the jurisdiction in which we operate.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
